Objetiva-se discutir o bem-estar animal diante do abate religioso. Hodiernamente, o Direito Animal faz-se crescente e pois, ordena um repensar científico, ético e legal no tratamento dos animais não humanos. E, ainda que exista uma norma cultural de animais usados para alimentação, termos como dignidade, senciência e bem-estar animal afloram principalmente no momento do abate. Neste universo, o recorte do abate religioso para produção de carne Halal e Kosher surge com especial interesse. Assim, a partir de profícua literatura, alcança-se tema controverso que envolve não apenas questões científicas e éticas, mas principalmente dogmas religiosos. Optou-se todavia, por priorizar o Direito Animal. Não se adentrou em altercações sobre abolicionismo e veganismo. Diante do estado atual das coisas que legaliza a produção de proteína animal, infere-se a incompatibilidade ética, científica e legal da garantia do bem-estar animal em face do apregoado abate humanitário. E, mais especificamente a jugulação cruenta executa a nos abates Halal e Kosher, em que pese práticas milenares, recrudesce intercorrências que desequilibram o bem-estar animal.||The objective is to discuss animal welfare in the face of religious slaughter. Today, Animal Law is growing and therefore orders a scientific, ethical and legal rethink in the treatment of non-human animals. And even though there is a cultural norm of animals used for food, terms such as dignity, sentience and animal welfare emerge especially at the time of slaughter. In this universe, the clipping of religious slaughter for the production of Halal and Kosher meat comes with special interest. This way, from a rich literature, a controversial theme is reached that involves not only scientific and ethical issues, but mainly religious dogmas. However, it was decided to prioritize animal rights. It did not get into altercations about abolitionism and veganism. Given the current state of affairs that legalizes the production of animal protein the ethical, scientific and legal incompatibility of the guarantee of animal welfare in the face of the proclaimed humanitarian slaughter is concluded. And more specifically the bloody jugulation performed in Halal and Kosher slaughters even with millennial practices, it strengthens complications that unbalance animal welfare.
