Between 1804 and 1817 the captaincy of Pernambuco was administered by Governor Caetano Pinto de Miranda Montenegro. As a bachelor of law and doctor at the University of Coimbra, Caetano Montenegro was one of the few literate to assume the administration of captaincies in Portuguese America. Most of his government took place during the Portuguese court’s stay in Rio de Janeiro, from 1808. Combining the policy developed by the Joanine court, which expanded towns, counties and instituted outside judges in several locations, the governor acted to expand the number of circumscriptions in the captaincy of Pernambuco. The expansion of the legal and administrative sphere served both the interests of the regent’s court and the elites of the captaincies. As we will seek to show, his legal background had a significant impact on the way he conducted his administration. As a magistrate, in addition to governing the captaincy of Pernambuco, he understood himself as an individual imbued with jurisdiction, with the power to say the law. Como bacharel em leis e doutor pela Universidade de Coimbra, Caetano Montenegro foi um dos poucos letrados a assumir a administração de capitanias na América portuguesa. A maior parte de seu governo ocorreu durante a estadia da corte portuguesa no Rio de Janeiro, a partir de 1808. Aliando-se a política desenvolvida pela corte joanina, que ampliou vilas, comarcas e instituiu juízes de fora em diversas localidades, o governador atuou para aumentar o número de circunscrições na capitania de Pernambuco. A expansão da esfera jurídica e administrativa atendia tanto aos interesses da corte do regente, quanto das elites das capitanias. Como buscaremos mostrar, sua formação jurídica teve significativo impacto na forma como conduziu sua administração. Como magistrado, além de governar a capitania de Pernambuco, entendia-se como um indivíduo imbuído de jurisdição, com o poder de dizer o direito. Tal entendimento e concepção política estiveram presentes nas solicitações que apresentou ao regente, ao tratar da necessidade de melhorar a prática da justiça na localidade.
