Objetiva este artigo enfocar o papel do Poder Judiciário na proteção dos direitos humanos, considerando a experiência brasileira, sob a ótica do direito internacional dos direitos humanos. Inicialmente será apreciado o direito à proteção judicial no marco direito internacional dos direitos humanos. É a partir desse contexto que se analisará os principais desafios e perspectivas para o fortalecimento da proteção judicial como garantia e instrumento de distribuição de justiça e da efetiva proteção de direitos.||The main purpose of this paper is to address the role of the Judiciary in protecting human rights, focusing on the Brazilian experience from the perspective of the International Human Rights Law. First, the analysis will be concentrated on the right to legal protection, taking into consideration the international human rights standards. Then the paper will deal with the key challenges and perspectives to strengthen legal protection as an effective tool and as a guarantee of the implementation of justice and promotion of rights.
