The present work analyzes the surface property right - slab right - recently introduced in the Brazilian Civil Code, through Federal Law no. 13.465 from 2017. The research was based on the Federal Constitution, in the Civil Code, in the doctrine and in the foreign legal order. In the course of the work, it was sought to demonstrate and then conclude that the slab right is a real property right and that the referred institute is a way to create investments and not a way to regularize the property of the low-income population.||O presente trabalho analisa o Direito de Laje, recentemente, introduzido no Código Civil brasileiro, por meio da Lei Federal n. 13.465 de 2017. A pesquisa lastreou-se na Constituição Federal, no Código Civil, na doutrina e no ordenamento jurídico estrangeiro. No decorrer do trabalhou, buscou-se demonstrar e concluiu-se que o direito de laje é direito real de propriedade e que referido instituto é forma de se criar investimentos e não forma de regularizar a propriedade da população de baixa renda.
