With the present paper the author finds the possibility of overcoming the current liberal-capitalist system in a different conception of time, which requires a different attitude towards both the past and the future. The paper begins with an analysis of the Benjamin’s critique of Marx, followed by analysis of Derrida’s critique of Benjamin and finally Derrida’s critique of Marx. Benjamin points out the problem of teleological understanding of time, the understanding that the meaning of events comes only from the future, which is present in Marx, and which prevents us from escaping the “circle” of violence. Although he relies on Benjamin’s conception of time, the author seeks to transcend the understanding of law as something separate from justice, and law as violence. Therefore, the paper turns to Derrida and his understanding of the law, eventually providing new possibilities for understanding and constituting the left, social theory, but also critical thinking today.||Com o presente artigo o autor pretende examinar a possibilidade de superação do atual sistema liberal-capitalista num contexto temporal diferente do atual, algo que exige uma atitude diversa em relação ao passado e ao futuro. O artigo inicia com uma análise da crítica de Walter Benjamin a Karl Marx seguido, da análise da crítica de Jacques Derrida a Benjamin e, finalmente, da crítica de Derrida a Marx. Benjamin aponta o problema da compreensão teleológica do tempo, a compreensão de que o sentido dos acontecimentos vem apenas do futuro, que está presente em Marx, e que nos impede de escapar do “círculo” da violência. Embora se apóie na concepção de tempo de Benjamin, o autor do presente artigo autor busca transcender a compreensão do direito como algo separado da justiça, bem como do direito entendido como violência. Para tanto, o artigo se volta para Derrida e sua compreensão do direito, acabando por oferecer novas possibilidades de compreensão e constituição da esquerda, da teoria social, mas também do pensamento crítico na atualidade.
